An amendment to the Labor Market Regulation Act (ZUTD-I) has been published.

On September 19, 2025, the Act Amending the Labor Market Regulation Act (ZUTD-I) was published in the Official Gazette, introducing a number of new provisions, including:

  • The maximum and minimum amounts of unemployment benefits are being increased, which are now determined as a percentage of the minimum wage and are also adjusted accordingly. The minimum amount of unemployment benefits will now be 70 percent of the gross minimum wage, and the maximum amount of unemployment benefits will be between 130 percent and 80 percent of the gross minimum wage, with the amount gradually decreasing. The changes will take effect on January 1, 2026.
  • The ESS will now be able to refuse to refer workers to employers who have been issued a warning in administrative proceedings or against whom misdemeanor proceedings have been initiated by the Labor Inspectorate of the Republic of Slovenia or the Financial Administration of the Republic of Slovenia, and to employers in which the ESS has found violations in the context of monitoring the fulfillment of contractual obligations and the intended use of APZ funds.
  • in the case of temporary or occasional work by pensioners, the limits on the permitted monthly and annual number of hours of such work are increased from 60 hours to 85 hours per month, resulting in an increase in the maximum annual calendar income;
  • The so-called 80/90/100 measure is being legalized, which refers to the possibility of working shorter hours before retirement. Employees who are older than 58 or have completed 35 years of pensionable service will be able to agree with their employer to work 80 percent of the time, receive 90 percent of their salary from which all taxes and contributions are paid, and for the purposes of pension and disability insurance, 100% of contributions will be considered paid. The measure will come into force gradually – in 2026 and 2027, the measure will apply to workers who turn 58 that year, and then the age requirement will increase by three months each year until it reaches 60 in 2035.
  • An incentive for the employment of persons over 59 years of age who are recipients of unemployment benefits is being introduced, whereby an unemployed person over 59 years of age who, during the period of entitlement to cash benefits, enter into a full-time employment relationship with an employer who is not their last employer prior to becoming unemployed and, in accordance with the law governing companies, is not an affiliated company of their last employer, the ESS shall, until the expiry of the period for which the right was granted, but for a maximum of 12 months after employment, pay a monthly employment incentive equal to 40 percent of the monthly net amount of the cash benefit granted on the date of conclusion of the employment contract;
  • New (additional) conditions are set for performing activities related to providing workers to users, namely the mandatory bank guarantee is increased from EUR 30,000 to EUR 100,000. and in order to perform these activities, a legal or natural person established in another EU Member State, EEA Member State or the Swiss Confederation must have a branch established in the Republic of Slovenia.
